Deputy Batz went to check on the driver, later identified as Mischelle Fremlin, age 47 of Magalia. Deputy Batz was initially unable to verbally wake up Fremlin from outside the vehicle. Deputy Batz opened the door of the vehicle (which was still running but in park) and Fremlin eventually woke up. Deputy Batz immediately observed signs Fremlin was under the influence of a controlled substance. Due to the state of Fremlin’s consciousness, Deputy Batz obtained verbal consent and performed a search of the vehicle. Inside, he located approximately 23 grams of methamphetamine, a scale, and additional drug paraphernalia.
Fremlin was arrested for possession of methamphetamine and possession of drug paraphernalia. Upon further investigation, it was determined Fremlin had multiple convictions for drug related offenses, so an additional charge was added of possession of a controlled substance with two or more priors. Fremlin was booked into the Butte County Jail.
